When you are looking at contract prisons, they are treated as part of the department for the purposes of the Ombudsmen Act 1975 and the Official Information Act 1982. You should think of them as being connected to the department when these Acts are applied. This means they follow the same rules as the department.

When security contractors and their security officers are doing certain jobs, like escort duties and courtroom custodial duties, you treat them as employees of the department. This is for the purposes of the Ombudsmen Act 1975 and the Official Information Act 1982. They have to follow the same rules as the department's employees when doing these jobs.
