If you did something before this law started that might be against the rules, you will still be dealt with under the old rules. The old rules are in sections 32 to 36 of the Penal Institutions Act 1954. When these old rules are used, the words "Superintendent" will mean "prison manager" and the word "inmate" will mean "prisoner". You will be treated as if the old rules still apply, even though they have been repealed by this new law. This means that if you are alleged to have committed an offence under section 32 or section 32A of the Penal Institutions Act 1954 before this law started, you can still be dealt with under those old rules.

233Sections 32 to 36 of Penal Institutions Act 1954 continue to apply to acts and omissions before commencement

  1. This section applies to any act or omission by a person before the commencement of this section that is alleged to constitute an offence under section 32 or section 32A of the Penal Institutions Act 1954.

  2. Every alleged offence to which this section applies may, on and after the commencement of this section, be dealt with under sections 32 to 36 of that Act, despite the repeal of those provisions by this Act, and sections 32 to 32A of the Penal Institutions Act 1954 continue to apply as if—

  3. for every reference to Superintendent there were substituted the words prison manager; and
    1. for every reference to inmate there were substituted the word prisoner.
