When someone is identified as a parent who needs to pay child support, the Commissioner will work out how much they need to pay. They will do this as soon as they can. The Commissioner will figure out how much the parent needs to pay for each child for the year. They will also work out the total amount the parent needs to pay for all their children for the year. If the request for child support was made in the previous year, the Commissioner will also work out the amounts for that year.

Each year after that, if the parent still needs to pay child support, the Commissioner will work out the amounts again for the new year. They will do this before the year starts, or as soon as possible after it starts.

The Commissioner must follow specific rules when they work out these amounts. These rules are explained in different parts of the law.

29Commissioner to assess child support payable under formula assessment

  1. As soon as practicable after identifying a liable parent under Part 1, the Commissioner must—

  2. assess the annual amount of child support payable by the liable parent in that child support year in respect of each of his or her qualifying children; and
    1. assess the annual rate of child support payable by the liable parent in that child support year in respect of all of his or her qualifying children; and
      1. where the application for a formula assessment was made in the previous child support year, make such assessments in relation to the previous child support year.
        1. Before, or as soon as practicable after, the start of each later child support year in which child support continues, or appears likely to continue, to be payable in respect of any qualifying child of the parent, the Commissioner must make the assessments referred to in subsection (1)(a) and (b) in relation to that later child support year.

        2. Every assessment must be done in accordance with this Part and Part 5.
