205: Recovery of financial support paid by one person on behalf of another

If you pay someone else’s financial support as required by this law, you can get that money back from the person who was supposed to pay it. You can do this by asking them to pay you back directly, or by taking the money from any payments you owe them. If you paid the financial support because you hold a mortgage on their property, the amount you paid will be added to the mortgage. This means the person will owe you more on their mortgage, and you can charge interest on this extra amount at the same rate as the rest of the mortgage.

205Recovery of financial support paid by one person on behalf of another

  1. Every person who in pursuance of this Act pays any financial support for or on behalf of any liable person shall be entitled to recover the amount so paid from the liable person as a debt, and to retain or deduct that amount out of or from any money which is or becomes payable by the person to the liable person; and if the person has paid the financial support as mortgagee, then, until repaid, it shall be deemed to form part of the money secured by the mortgage, and shall bear interest at the same rate accordingly.
