Child Support Act 1991

Collection of financial support - Discretionary relief in respect of penalties and pre-2021 penalties

135B: Discretionary relief if reasonable cause

You could also call this:

“You might get help if you have a good reason for late child support payments”

You might get some help if you have a good reason for being late with your child support payment. The person in charge, called the Commissioner, can decide to give you a break if two things are true:

  1. You had a good reason for not paying on time.
  2. You fixed the problem as soon as you could.

A good reason means something happened that you couldn’t control. It might be something like getting very sick, having an accident, or being in a disaster. The Commissioner will decide if your reason caused a fair delay in your payment.
