238: Applications by agents

If you want to apply for a formula assessment under this Act, you can ask someone else to do it for you. This person is called an agent. You need to give them written permission to act as your agent.

Sometimes, you might not be able to give someone permission to be your agent. This could happen if you’re very sick or have a disability that affects your thinking. In these cases, there are two options:

  1. If someone is officially in charge of looking after your affairs (called a manager under the Protection of Personal and Property Rights Act 1988), they can apply for you.

  2. If you don’t have a manager, a ‘next friend’ can apply for you. A next friend is someone who helps you with legal matters when you can’t do it yourself.

238Applications by agents

  1. A person who may apply for a formula assessment under this Act may do so by an agent authorised in writing by that person.

  2. If a person is incapable of authorising an agent under subsection (1) to make an application on that person's behalf—

  3. the manager of that person's estate under the Protection of Personal and Property Rights Act 1988 may make the application; or
    1. where there is no such manager, the next friend of the person may make the application.
