235: Regulations

“Rules made to help the Child Support Act work better”

The Governor-General can make rules, called regulations, to help make the Child Support Act work better. These regulations must not go against what the Act says. The regulations can do a few things:

They can say what jobs and duties people who work under this Act need to do.

They can make it against the law to break these regulations. If someone breaks them, they might have to pay a fine of up to $500.

The regulations can also cover anything else that’s needed to make the Act work properly.

When new regulations are made, they are called secondary legislation. This means they need to be published in a special way, which is explained in Part 3 of the Legislation Act 2019.

235Regulations

  1. The Governor-General may from time to time, by Order in Council, make regulations, not inconsistent with this Act, for all or any of the following purposes:

            1. prescribing the duties and functions of officers and other persons appointed or employed under this Act:
              1. prescribing offences in respect of the contravention of or non-compliance with any regulations made under this Act, and the amount of the fines that may be imposed in respect of any such offences, which fines shall be an amount not exceeding $500:
                1. providing for such matters as are contemplated by or necessary for giving full effect to the provisions of this Act and for its due administration.
                  1. Regulations under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
