This part of the law applies to certain types of court orders about money for family support made on or after 1 July 1992. You need to know about four types of orders:

First, it applies to orders made in New Zealand that require someone to pay at least $520 per year for family support.

Second, it covers orders made in other countries that have been officially recognised in New Zealand. These could be from Commonwealth countries or other countries that New Zealand has an agreement with.

Third, it includes orders that change or cancel existing family support arrangements.

Fourth, it applies to orders made when someone from overseas asks a New Zealand court to change a family support order.

All of these orders must have been made on or after 1 July 1992 for this part of the law to apply to them.

Part 4 Court maintenance orders made after 1 July 1992

67Application of this Part

  1. This Part shall apply to—

  2. any maintenance order or interim maintenance order made under Part 6 of the Family Proceedings Act 1980 on or after 1 July 1992 that provides for payments to be made at an annual rate of not less than $520:
    1. any maintenance order made against any person by any court in a Commonwealth or designated country that has on or after 1 July 1992—
      1. been registered in New Zealand under the Family Proceedings Act 1980; or
        1. been confirmed in New Zealand under that Act (other than an order confirmed under section 139 of that Act):
        2. any order made pursuant to section 78 or section 81 of the Family Proceedings Act 1980 on or after 1 July 1992:
          1. any order made under Part 6 or Part 8 of the Family Proceedings Act 1980 on or after 1 July 1992 in respect of an application under section 145 of that Act.
