You can ask someone else to apply for an exemption for you. This person is called an agent. You need to give them written permission to do this for you.

If you can't give someone permission to be your agent, there are two other ways to get help:

  1. If someone manages your money and property for you under the Protection of Personal and Property Rights Act 1988, they can apply for the exemption for you.

  2. If you don't have someone managing your money and property, a 'next friend' can apply for you. A next friend is usually someone close to you who looks out for your interests.

89ZEApplications by agents

  1. A person who may apply for an exemption under this Part may do so by an agent authorised in writing by that person.

  2. If a person is incapable of authorising an agent under subsection (1) to make an application on that person's behalf,—

  3. the manager of that person's estate under the Protection of Personal and Property Rights Act 1988 may make the application; or
    1. if there is no manager under paragraph (a), the next friend of the person may make the application.
