If the Commissioner decides to start proceedings about child support, they must write to the people who take care of the children and any parent who has to pay child support (except the parent who is the main focus of the proceedings). The Commissioner’s letter will tell you:

  1. That they have decided to start proceedings.

  2. That you have the right to choose what happens next, as explained in section 96Y.

  3. That you, the parent who is the main focus, and anyone else who can make choices under section 96Y, can write to the Commissioner with your thoughts and ask for information. This is explained in section 96Z.

96XCommissioner to notify receiving carers and liable parent with rights of election under section 96Y

  1. If the Commissioner decides to start proceedings under this Part, the Commissioner must notify the receiving carers and any liable parent who is not the subject parent, in writing, of—

  2. the Commissioner's decision; and
    1. the receiving carer's or liable parent's rights of election under section 96Y; and
      1. the rights of the subject parent and of any receiving carer or liable parent who has rights of election under section 96Y to make written representations and receive information in accordance with section 96Z.
