You hold an employer licence if you had one before this law started. Your licence is like one issued under Part 2 of this law. You can renew it under Part 2. Your licence expires on the date it would have expired before this law. It lets you allow employees to do gasfitting work. Your licence has the same conditions as before. The Board can still cancel or suspend your licence under subpart 2 of Part 2. They can use other powers under this law too.

176Persons holding employer licences

  1. Every person who, immediately before the commencement of this section, held an employer licence under the former Act is, on and from the commencement of this section, deemed to be a person who holds an employer licence issued under Part 2.

  2. The licence that a person is deemed to hold under subsection (1) is deemed to—

  3. expire on the date on which the employer licence under the former Act would have expired if this Act had not been enacted (but may be renewed under Part 2); and
    1. authorise the holder of the licence to authorise any employee of that person to do, or assist in doing, any gasfitting; and
      1. be subject to any conditions, limitations, or restrictions that, immediately before the commencement of this section, were imposed by or under the former Act on the person’s licence.
        1. Nothing in this section prevents the Board from—

        2. cancelling or suspending the employer licence that a person is deemed to hold under subsection (1) in accordance with subpart 2 of Part 2; or
          1. exercising any other power in relation to that licence under this Act.
