When you appeal under section 162, the appeal must be heard as soon as possible. You will have your appeal heard by the District Court. The District Court will make a decision on your appeal. The District Court can confirm, reverse, or modify the decision that was made. They can also make a new decision or give a new direction. This means they can change the original decision or make a completely new one. The District Court can only review the part of the decision that you are appealing. They cannot look at other parts of the decision. Their decision is final, unless it says otherwise in section 169. The District Court's decision on your appeal under section 162 is final, unless section 169 says otherwise. Their decision will be the one that you have to follow.

164Procedure on appeal

  1. Every appeal under section 162 must be heard as soon as practicable after the appeal is lodged.

  2. On the hearing of an appeal under section 162, the District Court may—

  3. confirm, reverse, or modify the decision, direction, or order of the Board or the Registrar; or
    1. give any decision, or make any direction or order, that the Board or the Registrar could have given or made in respect of the matter.
      1. Nothing in this section gives the District Court power to review any part of the decision, direction, or order of the Board or the Registrar other than the part against which the appellant has appealed.

      2. Subject to section 169, the decision of the District Court on any appeal under section 162 is final.
