When you make a complaint, the Board must tell the self-containment certification authority about it. The Board then decides whether to accept or decline your complaint. You will be told what the Board decides. If the Board has not yet decided what to do with your complaint, they do not have to ask the self-containment certification authority for information. The self-containment certification authority cannot give the Board information unless they are asked to. After the Board makes a decision, they must tell you and the self-containment certification authority what they have decided. If the Board decides to accept your complaint, they will investigate it. The Board can decline to accept a complaint if they think it is vexatious or frivolous, and they do not have to investigate it.

87JProcedure if Board deciding whether to accept or decline complaint

  1. The Board must, as soon as practicable after receiving a complaint,—

  2. inform the self-containment certification authority concerned of the complaint; and
    1. decide whether to accept or decline the complaint.
      1. If the Board has received a complaint but has not yet decided whether to accept or decline the complaint, then—

      2. the Board is not required to seek any information or submission from the self-containment certification authority; and
        1. the self-containment certification authority is not entitled to submit any information or submission, unless requested to do so by the Board.
          1. The Board must, immediately after making a decision under subsection (1),—

          2. give written notice of the decision to the person who made the complaint and the self-containment certification authority concerned; and
            1. if the Board decides to accept the complaint, investigate the complaint.
              1. The Board may decline to accept, and is not required to investigate, a complaint that it considers vexatious or frivolous.
