172Regulations

  1. The Governor-General may, by Order in Council, make regulations for all or any of the following purposes:

  2. prescribing, for the purposes of subpart 2 of Part 2, requirements in relation to the system of operation to be maintained by employer licence holders:
    1. designating a person or a class of persons as approved persons for the purposes of section 62:
      1. prescribing the manner in which approved persons may certify a system of operation for the purposes of section 62:
        1. prescribing procedures, requirements, and other matters, not inconsistent with this Act, for the register, including matters that relate to—
          1. the operation of the register:
            1. the form of the register:
              1. the information to be contained in the register:
                1. access to the register:
                  1. the location of, and hours of access to, the register:
                    1. search criteria for the register:
                    2. prescribing the limits or scope of work which any registered persons or any person to whom any of the provisions of sections 12 to 25 applies may do or assist in doing:
                      1. restricting and regulating the performance of particular kinds of sanitary plumbing, gasfitting, or drainlaying, whether by reference to the nature of the work or by reference to the kind of premises, operations, equipment, materials, or substances involved, or otherwise:
                        1. prohibiting or restricting persons (whether or not they are registered persons), or any specified class of persons, or persons not possessing specified qualifications or not belonging to a specified class, from performing any specified kinds of sanitary plumbing, gasfitting, or drainlaying work:
                          1. prescribing sanitary plumbing and drainlaying for which a registered person or provisional licence holder must provide a record of work under section 27A:
                            1. prescribing 1 or more forms for a record of work under section 27A:
                              1. regulating the procedure of the Board:
                                1. prescribing infringement offences:
                                  1. setting the infringement fee for each infringement offence, which,—
                                    1. in the case of an individual, must not exceed $1,000; or
                                      1. in the case of a body corporate, must not exceed $3,000:
                                      2. prescribing information to be included in infringement notices and reminder notices:
                                        1. prescribing transitional or savings provisions relating to the coming into force of this Act:
                                          1. providing for anything incidental that is necessary for carrying out, or giving full effect to, this Act.
                                            1. The Governor-General may, by Order in Council made on the recommendation of the Minister, make regulations providing for anything that Part 2A of this Act says may or must be provided for by regulations.

                                            2. Any regulation made under subsection (1) or (1A) may make different provisions in respect of different classes of persons.

                                            3. Any transitional or savings provisions prescribed in regulations made under subsection (1)(l) are in addition to the provisions of sections 173 to 184.

                                            4. All regulations made under subsection (1)(l) that are still in force on the day that is 3 years after the commencement of this section expire at the close of that day.

                                            5. Regulations under this section are secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).
