9: Powers of responsible Minister

The responsible Minister has some important powers. You can think of powers like special jobs they have to do. They can do things like perform functions in section 7A.

The Minister can also recommend that the Governor-General make Orders in Council under section 45(3). They can assign responsibility for decisions under section 55. The Minister can recommend that the Governor-General approve the national policy direction under section 57.

The Minister has more powers, like approving amendments to the national policy direction under section 58(2). They can recommend that the Governor-General approve the revocation and replacement of the national policy direction under section 58(3). The Minister can publish notices about industry organisations under section 100ZA(2).

The Minister can also recommend that the Governor-General make Orders in Council imposing readiness and response levies under section 100ZB(1). They can recommend that the Governor-General make Orders in Council imposing levies under section 137(1) or section 140AA(3). The Minister can recommend that the Governor-General make regulations under section 165.

The responsible Minister cannot delegate these powers to anyone else. This means they cannot ask someone else to do these special jobs for them.

9Powers of responsible Minister

  1. The responsible Minister has power to—

  2. perform the functions in section 7A:
      1. recommend to the Governor-General the making of Orders in Council under section 45(3):
        1. assign responsibility for decisions under section 55:
          1. recommend to the Governor-General the approval of the national policy direction under section 57:
            1. recommend to the Governor-General the approval of amendments to the national policy direction under section 58(1):
              1. approve amendments to the national policy direction under section 58(2):
