If your goods have post-clearance requirements in an import health standard, you must take all reasonable steps to ensure that the goods comply with the requirements. You may also be required by an inspector to provide a declaration in an approved form, which sets out the steps you took to comply with the requirements. You must provide this declaration to the inspector in an approved manner.

The Director-General may issue a permit that a standard specifies as a requirement if they consider it appropriate to do so. This means you might get a permit if the Director-General thinks it is the right thing to do.

24DCompliance

  1. A person to whose goods post-clearance requirements in an import health standard apply must—

  2. take all reasonable steps to ensure that the goods comply with the requirements; and
    1. if required by an inspector, do the following:
      1. provide the inspector with a declaration in an approved form setting out the steps taken to comply with the requirements; and
        1. provide the inspector with the declaration in an approved manner.
        2. The Director-General may issue a permit that a standard specifies as a requirement if the Director-General considers it appropriate to do so.
