142H: Retention and use of information for risk profiling

The Director-General can collect and use information to work out if something or someone might be a risk in the future. You might have given this information to the Director-General, or it might have come from a border sector agency, or from somewhere else. The Director-General can use this information to decide how to use their powers under the Biosecurity Act 1993.

The Director-General can use the information to develop an assessment of the risk that craft, goods, or persons may present in future. They can also use the information to develop criteria for making decisions or taking actions under the Biosecurity Act 1993.

Risk profiling

142HRetention and use of information for risk profiling

  1. Subsections (2) and (3) apply to information—

  2. provided to the Director-General under this Act; or
    1. disclosed to the Director-General by a border sector agency; or
      1. held by the Director-General after coming to the Director-General from another source.
        1. The Director-General may collect, retain, analyse, process, or use information for the purpose of developing—

        2. an assessment of the risk that craft, goods, or persons may present in future:
          1. criteria for the exercise of powers or the carrying out of functions or duties under this Act.
            1. A person exercising powers or carrying out duties or functions under this Act may apply a risk assessment or criteria developed under subsection (2).
