11: Other powers of Ministers

You have certain powers as a Minister. You can direct the forfeiture of organisms and organic material under section 134(3). You can take action under sections 144 and 147 in relation to biosecurity emergencies.

You can also take action under section 145 in relation to biosecurity emergencies. You can recommend to the Governor-General under section 150(1) the making of biosecurity emergency regulations.

You have the duty of laying these regulations before the House of Representatives under section 150(5). You can declare a provisional control programme under section 152(1). You can extend a provisional control programme under subsection (3) of section 152.

You cannot delegate some of your powers to other people, including taking action under subsections (1)(b), (d), (e), and (f).

11Other powers of Ministers

  1. Any Minister has power to—

  2. direct the forfeiture of organisms and organic material under section 134(3):
    1. take action under sections 144 and 147 in relation to biosecurity emergencies:
      1. take action under section 145 in relation to biosecurity emergencies:
        1. recommend to the Governor-General under section 150(1) the making of biosecurity emergency regulations, and where such regulations are made, the Minister has the duty of laying them before the House of Representatives under section 150(5):
          1. declare a provisional control programme under section 152(1):
            1. extend under subsection (3) of section 152 a provisional control programme.
              1. A Minister must not delegate to any person the exercise of the powers specified in subsection (1)(b), (d), (e), and (f).
