If you own or operate a craft, you might want to make a special plan to manage risks. This plan must be equivalent to the standard rules, but can be different. You have to make the plan and send it to the Director-General for approval.

The Director-General will approve your plan if they think it can manage risks as well as, or better than, the standard rules. They will include a statement about what your plan applies to. They might also say how long the approval is valid.

If the Director-General is not happy with your plan, they can withdraw their approval or ask you to make changes. You can send them draft amendments, and they can approve them or ask for more changes. If you do not make the changes, the Director-General can withdraw their approval.

If your plan is approved, you do not have to follow the standard rules for the activities in your plan. You must follow your plan, and if an inspector asks, you have to provide a declaration saying what you have done to comply with the plan. You have to give the declaration to the inspector in an approved way.

24KCraft risk management plans

  1. This section applies if a person—

  2. is an owner or an operator, or the person in charge, of a craft; and
    1. wants to operate under a craft risk management plan containing requirements that are equivalent to but different from those specified in the applicable craft risk management standard.
      1. The person must—

      2. make the plan; and
        1. submit it to the Director-General for approval.
          1. The Director-General may approve the plan if satisfied that the risks can be managed under the plan to the same extent as, or a greater extent than, they can be managed under the applicable craft risk management standard.

          2. The Director-General must include in the approval of the plan a statement of the class or description of activity to which it applies.

          3. The Director-General may include in the approval of the plan a statement of the period for which the approval is valid.

          4. If the Director-General ceases to be satisfied under subsection (3), the Director-General may—

          5. withdraw the approval; or
            1. follow the following process:
              1. the Director-General informs the person of the aspects of the plan that have ceased to satisfy the Director-General; and
                1. the person may submit draft amendments to the Director-General; and
                  1. the Director-General may approve the draft amendments or require other amendments; and
                    1. whether or not the person submits draft amendments to the Director-General, the Director-General may withdraw approval of the plan if it is not amended to the Director-General's satisfaction within a reasonable time.
                    2. Throughout the period that the plan has the approval of the Director-General, a person who complies with the plan for an activity to which the plan applies does not have to comply also with the applicable craft risk management standard for the activity.

                    3. An operator, or the person in charge, of a craft to which a craft risk management plan applies must—

                    4. comply with the plan; and
                      1. if required by an inspector, do the following:
                        1. provide the inspector with a declaration in an approved form setting out the steps taken to comply with the plan; and
                          1. provide the inspector with the declaration in an approved manner.
