When you want to bring goods into New Zealand, an inspector checks them first. The inspector must not give a biosecurity clearance for goods that have an organism listed in Schedule 2 of the Hazardous Substances and New Organisms Act 1996 or for a new organism.

However, if the goods have a new organism that was imported by accident, the inspector can still give a biosecurity clearance.

If a new organism has been approved for importation into a special facility, and there is a suitable facility available, and the organism can be taken to that facility, then an inspector can allow the organism to go to that facility, as long as the importation was approved under sections 42 or 45 of the Hazardous Substances and New Organisms Act 1996.

28Restrictions on giving clearances

  1. An inspector must not give a biosecurity clearance for goods that are or contain an organism specified in Schedule 2 of the Hazardous Substances and New Organisms Act 1996 or for a new organism.

  2. However, subsection (1) does not prohibit an inspector from giving a biosecurity clearance for goods the importation of which involves, or might involve, an incidentally imported new organism.

  3. Where any new organism is an organism for which—

  4. the Authority has given approval for importation into containment in accordance with sections 42 or 45 of the Hazardous Substances and New Organisms Act 1996: and
    1. there is in existence a containment facility approved as meeting the standard set by the Authority; and
      1. the organism is able to go to that facility,—
        1. any inspector may authorise that organism to go to that containment facility.
