Administrative powers
121Power to examine organisms
An inspector or authorised person may exercise any or all of the powers in subsection (1B) on—
- organisms:
- organic material:
- any other goods or material.
The purposes for which the inspector or authorised person may exercise the powers are—
- taxonomical identification of an organism:
- diagnosing a disease:
- determining whether imported goods may be given a biosecurity clearance:
- ascertaining the presence or absence of any pest or unwanted organism:
- making an assessment of measures taken to eradicate or manage any pest or unwanted organism.
The powers are to—
- autopsy:
- destroy:
- examine:
- inspect:
- sample:
- section:
- take specimens:
- test:
- apply any other treatment or procedure.
Every owner or person in control of any organism, and every occupier of a place in which any organism is present, shall, whenever required by an inspector or authorised person by written notice to do so, submit the organism specified in the notice for the purposes of subsection (1A).
Where an inspector or authorised person has under subsection (2) required the submission of any organism an inspector or authorised person may direct the owner or person in control of the organism, or the occupier of any place where it is present, to bring it—
- in a specified manner:
- to a specified place:
- on a specified day:
- for a specified purpose.
If the owner or person in control of any animal or the occupier of any place in which an animal is present fails to comply with a direction under this section, an inspector or authorised person may—
- exercise any or all of the powers in subsection (1B); and
- in the case of any animal or animals,—
- to the extent that it is necessary to enable those powers to be exercised (or exercised efficiently), capture, pen, or muster it or them or any of them; or
- if for any reason it is not practicable to capture, pen, or muster it or them or any of them, kill or destroy it or them or any of them if the inspector or authorised person believes on reasonable grounds that it is necessary to do so for the purpose of controlling pests or unwanted organisms.
- to the extent that it is necessary to enable those powers to be exercised (or exercised efficiently), capture, pen, or muster it or them or any of them; or
Costs and expenses reasonably incurred by an inspector or authorised person in taking any action under subsection (4) may be recovered as a debt due from the person who failed to comply with the direction concerned.
