10: Functions of Ministers in relation to national plans

As a Minister, you can do the jobs listed in Part 5. You can also do other jobs like approving plans, recommending that the Governor-General make Orders in Council, and appointing agencies to manage plans. You can find more information about these jobs in sections like section 64(1), section 66(1), section 84(1), and section 86(1).

You can also appoint a management agency for a plan under section 100(4), disallow an operational plan under section 100B(4), and review or amend a plan under section 100D. Additionally, you can recommend that the Governor-General make an Order in Council to impose a levy under section 100L(1).

You cannot ask someone else to do these jobs for you, as stated in subsection 3, no Minister can delegate the carrying out of these functions.

10Functions of Ministers in relation to national plans

  1. Any Minister may carry out the functions specified in Part 5 as the functions of a Minister.

  2. Any Minister may carry out the functions of—

  3. approving the preparation of a national pest management plan under section 64(1):
    1. recommending to the Governor-General the making of an Order in Council making a national pest management plan under section 66(1):
      1. approving the preparation of a national pathway management plan under section 84(1):
        1. recommending to the Governor-General the making of an Order in Council making a national pathway management plan under section 86(1):
          1. appointing a management agency for a plan under section 100(4):
            1. disallowing an operational plan or part of it under section 100B(4):
              1. reviewing, amending, revoking and replacing, or revoking a plan under section 100D:
                1. recommending to the Governor-General the making of an Order in Council imposing a levy under section 100L(1).
                  1. No Minister may delegate the carrying out of the functions in subsection (2).
