113: Power to record information

When you are allowed to use certain powers, you can also record information. You can make copies of documents or information stored on computers or other devices. You can take documents, tapes, or discs from where they are kept for a reasonable time.

You can also ask someone to help you get the information from a computer or device in a usable form. This is allowed if you are using powers from section 109 or section 111. You must only keep the documents, tapes, or discs for as long as you need to.

113Power to record information

  1. A person lawfully exercising the powers conferred by section 109 or section 111 may make or take copies of any document or any information recorded or stored in a computer or other device, and for that purpose may take possession of and remove any document, tape, or disc from the place where it is kept for such period of time as is reasonable in the circumstances, or may require a person to reproduce, or assist the inspector or authorised person to reproduce, in usable form information recorded or stored in a computer or other device.
