The Minister can ask the Governor-General to make small changes to a national pest management plan or a national pathway management plan. You need to know that this can happen without a big review under section 100D, if the Minister thinks the change will not affect people's rights and obligations much and is not inconsistent with the national policy direction. The Minister must be satisfied that the change meets these conditions.

The Governor-General can then make the order to change the plan. You should be aware that this order is a type of law called secondary legislation, which has its own publication requirements - you can learn more about this in Part 3 of the Legislation Act 2019.

100GMinor changes to plans

  1. The Minister may recommend to the Governor-General the amendment of a national pest management plan or a national pathway management plan by Order in Council without a review under section 100D, if the Minister is satisfied that the amendment—

  2. does not have a significant effect on any person's rights and obligations; and
    1. is not inconsistent with the national policy direction.
      1. The Governor-General may make the order.

      2. An order under this section is secondary legislation (see Part 3 of the Legislation Act 2019 for publication requirements).

      3. A regional pest management plan or a regional pathway management plan may be amended from time to time by a council by resolution without a review under section 100D, if the council is satisfied that the amendment—

      4. does not have a significant effect on any person's rights and obligations; and
        1. is not inconsistent with the national policy direction.
