25Goods to be cleared for entry into New Zealand
No person may cause or permit any uncleared goods imported on any craft to leave that craft, except to proceed to a transitional facility or a biosecurity control area.
A person may cause or permit uncleared goods that are in a transitional facility, biosecurity control area, or containment facility to leave the facility or area only if subsection (3) or (4) applies.
Uncleared goods that are in a transitional facility, biosecurity control area, or containment facility may leave the facility or area to be exported from New Zealand, if an inspector authorises their export.
Uncleared goods that are in a transitional facility, biosecurity control area, or containment facility may leave the facility or area if an inspector authorises their movement to a transitional facility, biosecurity control area, or containment facility.
An authorisation may—
- specify how the goods must be moved:
- specify a time period within which the goods must be moved:
- specify how the goods must be dealt with at their destination.
An authorisation may impose conditions.
An authorisation may be given to—
- a facility operator:
- a person in charge of the goods in any capacity at a particular time:
- another person in charge of the goods in any capacity at the same or a later time:
- a person in possession of the goods at a particular time:
- another person in possession of the goods at the same or a later time.
A person to whom an inspector gives an authorisation must—
- act within its terms; and
- take all reasonable steps to communicate its terms to all other persons who come into possession or control of the uncleared goods to which the authorisation relates; and
- take all other reasonable steps to ensure that other persons act within its terms.
A person who comes into possession or control of the uncleared goods to which an authorisation relates and has had the terms of the authorisation communicated under subsection (8)(b) must act within the terms.
