40BNotice requirements

  1. If the Director-General suspends an approval under section 40A(1), the Director-General must give written notice to the facility operator.

  2. The Director-General must give the notice before the suspension takes effect.

  3. The notice must specify—

  4. the reason for the suspension; and
    1. the period of the suspension; and
      1. the date on which, or the date and time at which, the suspension starts; and
        1. the steps to be taken to enable the suspension to be lifted.
          1. If the Director-General extends the period of suspension under section 40A(3), the Director-General must give written notice to the facility operator.

          2. The Director-General must give the notice before the expiry of the original suspension.

          3. The notice must specify—

          4. the reason for the extension; and
            1. the period of the extension; and
              1. the date on which, or the date and time at which, the extension starts; and
                1. the steps to be taken to enable the extension to be lifted.
