46: Duty to report notifiable organisms

If you suspect there is an organism in a place in New Zealand, you must report it. You need to think it might be a notifiable organism, as stated in subsection (2) of section 45. You also need to believe it is not already established in that place and that the chief technical officer does not know about it.

If you suspect there is an organism in a regional council area, you must report it. You need to think it might be an organism that must be reported in that area, as stated in subsection (3) of section 45. You also need to believe it is not already established in that place and that the chief technical officer does not know about it.

You must tell the chief technical officer about the organism without waiting too long. This applies to both situations, in New Zealand as a whole and in a regional council area. You have a duty to report the organism if you suspect it is present and notifiable.

46Duty to report notifiable organisms

  1. Every person who—

  2. at any time suspects the presence of an organism in any place in New Zealand; and
    1. suspects that it is for the time being declared to be a notifiable organism under subsection (2) of section 45; and
      1. believes that it is not at the time established in that place; and
        1. has no reasonable grounds for believing that the chief technical officer is aware of its presence or possible presence in that place at that time,—
          1. shall without unreasonable delay report to the chief technical officer its presence or possible presence in that place at that time.

          2. Every person who—

          3. at any time suspects the presence of an organism in a place in the region, or in any part of the region, of a regional council; and
            1. suspects that it is for the time being declared to be an organism notifiable within the region or part under subsection (3) of section 45; and
              1. believes that it is not at that time established in that place; and
                1. has no reasonable grounds for believing that the chief technical officer is aware of its presence or possible presence in that place at that time,—
                  1. shall without unreasonable delay report to the chief technical officer its presence or possible presence in that place at that time.
