142: Resolution of disputes

When you have a dispute about paying a levy, the order will say how to resolve it. The order will appoint arbitrators to decide if you have to pay the levy and how much you have to pay. You can appeal to a District Court Judge if you do not agree with the arbitrators' decision.

The order will also say how the arbitrators will work and how they will be paid. It will explain how the costs of the arbitration will be paid. The order might cover other things related to resolving disputes about levies.

142Resolution of disputes

  1. Every order under section 137 shall provide for—

  2. the appointment of arbitrators to resolve disputes as to—
    1. whether or not any person is required to pay the levy concerned:
      1. the amount of levy any person is required to pay; and
      2. the procedures to be followed by arbitrators; and
        1. remuneration of arbitrators; and
          1. the payment of arbitration costs; and
            1. a right of appeal to a District Court Judge against decisions of arbitrators and the procedures governing the exercise of that right; and
              1. any other matters relating to the resolution of such disputes.
