23: Refusal to register programme

If you apply to register a risk management programme, the Director-General will consider your application and any extra information you provide under section 21. The Director-General will tell you why they might not register your programme and give you a chance to respond in writing or in person. You will get a notice with details about why the Director-General does not want to register your programme. The Director-General will also give you a reasonable opportunity to make written submissions or be heard about the matter. If the Director-General decides not to register your programme, they will tell you in writing and explain why. If someone acting for the Director-General declines to register your programme, you can ask for a review of that decision under section 162.

23Refusal to register programme

  1. If, after considering an application and any further information or material supplied under section 21, the Director-General proposes to refuse to register a risk management programme, the Director-General must give the applicant—

  2. a notice containing such particulars as will clearly inform the applicant of the grounds on which the Director-General proposes to refuse to register the programme; and
    1. a reasonable opportunity to make written submissions or be heard in respect of the matter.
      1. Where the Director-General finally determines to refuse to register a programme, the Director-General must as soon as practicable notify that fact to the applicant in writing, giving reasons.

      2. If a person acting under the delegated authority of the Director-General declines to register a risk management programme, the applicant may seek a review of that decision under section 162.
