167A: Notification of notices under section 167

When a notice is issued under section 167, it has to follow some rules. You need to know that this does not apply to notices for section 60. The notice has to say what it is about and who it affects.

If the notice is a type of law called secondary legislation, the Director-General must make sure people who will be affected by it know about it. They can do this by putting a notice in a newspaper or trade journal, or by using electronic means. The Director-General has to choose a method that is practical.

If the notice is not secondary legislation, the Director-General must give a copy of it to the person named in the notice, as explained in section 167(6). 167ANotification of notices under section 167

  1. This section applies to a notice issued under section 167, other than a notice for the purposes of section 60.

  2. If the notice is secondary legislation, in addition to complying with the Legislation Act 2019, the Director-General must (if the Director-General considers it practicable) cause it to be brought to the attention of persons likely to be affected by it—

  3. by a notice or publication in any newspaper or trade journal; or
    1. by any other practicable means (including electronic means).
      1. If the notice is not secondary legislation (see section 167(6)), the Director-General must give a copy of it to the person named in it.
