When the Director-General decides to suspend a recognised agency, person, or class, they must tell them as soon as possible. You will be told if you are a recognised agency or person that your recognition is being suspended. The Director-General must also tell a recognised agency if a person they are responsible for is suspended, and tell a recognised person if the agency they are part of is suspended.

The Director-General will give you a written notice if you are a recognised agency or person, or they will notify you according to section 112W if you are a recognised class. This notice will say why your recognition is being suspended, when the suspension starts, and how long it will last. It will also say what functions and activities the suspension relates to, and any conditions or actions you must take as required by section 112J(3) or section 112K(3).

The notice may also tell you that you have the right to ask for a review of the decision to suspend your recognition, as stated in section 162. The Director-General can also publish the suspension in the Gazette, which is an official government publication. When the law talks about suspension, it also means extending a suspension that already exists.

Suspension of recognition

112LMethod of suspension of recognition

  1. The Director-General must, as soon as practicable after deciding to suspend, or extend the suspension of, a recognised agency, recognised person, or recognised class, notify—

  2. a recognised agency or recognised person of the suspension of the agency or person; and
    1. a recognised agency of the suspension of a recognised person for whom the agency is responsible; and
      1. a recognised person of the suspension of any recognised agency that is responsible for that person; and
        1. a recognised class of the suspension of the class.
          1. A notice of suspension must—

          2. be given to a recognised agency or a recognised person by notice in writing; and
            1. be given to a recognised class by notifying the class in accordance with section 112W; and
              1. specify—
                1. the reason for the suspension; and
                  1. the date and time the suspension starts; and
                    1. the period of the suspension; and
                      1. the specified functions and activities that the suspension relates to; and
                        1. any conditions or corrective actions imposed under section 112J(3) or 112K(3); and
                        2. if applicable, set out the right of the recognised agency, recognised person, or recognised class (under section 162) to seek a review of the decision to suspend the recognition of the agency, person, or class.
                          1. The Director-General may notify any suspension of recognition in the Gazette.

                          2. In subsections (1) to (3), suspension includes an extension of a suspension.
