153: Compliance with compliance order

If a compliance order is given to you, you must follow the order. You also have to pay the costs of following the order, unless the order says you do not have to. You have to do what the order says and pay for the costs of doing it. If you do not follow the order, the Director-General can do what the order says on your behalf.

If the Director-General does what the order says for you, they can use the powers given to animal product officers under the Animal Products Act 1999. The Director-General can also ask you to pay back the costs of doing what the order says as a debt. You will have to pay the Director-General the costs of them following the order for you.

153Compliance with compliance order

  1. Where a compliance order is served on the person against whom it is directed, the person must—

  2. comply with the order; and
    1. unless the order directs otherwise, pay all the costs and expenses of complying with the order.
      1. If the person fails to comply with the order, the Director-General may comply with the order on behalf of the person, and, for this purpose, may—

      2. exercise, or direct the exercise of, any of the powers of an animal product officer under this Act; and
        1. recover the costs and expenses of complying with the order as a debt due from the person.
