112H: Duties of recognised persons

When you carry out your specified functions and activities, you must ensure you do things correctly. You must only do tasks that are part of your job and make sure you have the necessary skills. You must also be impartial and independent, and keep confidential information secret, especially about businesses and their operations. You have to report certain things to the Ministry, like any failures to comply with rules or problems with risk management programmes. You must follow the conditions of your recognition, as stated in section 111, and any directions given under section 81, and comply with all the requirements of this Act.

Performance of specified functions and activities

112HDuties of recognised persons

  1. When carrying out his or her specified functions and activities, a recognised person must ensure that he or she—

  2. carries out only functions and activities that are within the scope of those specified; and
    1. maintains all competency requirements applicable to his or her recognition; and
      1. maintains an appropriate degree of impartiality and independence; and
        1. maintains appropriate confidentiality (particularly in respect of commercially sensitive matters) relating to operations and activities the person comes into contact with in the course of carrying out those functions and activities (except to the extent that the person is required to report under paragraph (e) or otherwise for the purposes of this Act), including matters relating to design, technology, systems, personnel, and practices; and
          1. reports to the Ministry (or any other specified authority), in accordance with any applicable requirements of this Act,—
            1. any matter that a recognised person is required to report; and
              1. for a verifier, any failure to comply with, or any inadequacy in, a risk management programme; and
                1. for a recognised person who carries out functions and activities in relation to a regulated control scheme, any failure to comply with the scheme; and
                2. complies with all conditions of recognition imposed under section 111; and
                  1. complies with all applicable directions given under section 81; and
                    1. complies with all applicable requirements of this Act.
