65J: Delisting

The Director-General can remove a game estate from the list if you ask them to, or if they think the estate no longer meets the criteria mentioned in section 65H, or if it is not operated as a game estate anymore. They can also remove it if you have not paid the listing fee on time and it has been more than 30 days. If the Director-General wants to remove a game estate for these reasons, they must tell you in writing and give you a chance to explain why it should not be removed, or to pay the fee you owe. The Director-General removing a game estate from the list does not stop you from applying to have it listed again under section 65G.

65JDelisting

  1. The Director-General may remove any game estate from the list if—

  2. the listed operator so requests; or
    1. the Director-General is satisfied that the criteria referred to in section 65H no longer apply, or the place is no longer operated as a game estate; or
      1. any failure to pay the listing fee (if any) by the due date has persisted for more than 30 days.
        1. Before delisting a game estate on any of the grounds referred to in subsection (1)(b) and (c), the Director-General must—

        2. notify the game estate operator in writing of his or her intention; and
          1. give the person a reasonable opportunity, within the time specified in the written notice, to explain why the game estate should not be delisted, or to pay the unpaid fee.
            1. The delisting of a game estate under this section does not affect the right of a person to make a further application for listing under section 65G.
