The Director-General can recognise you to do certain jobs and activities if you apply as a natural person. You have to ask the Director-General to be recognised. The Director-General must think about whether you should be managed by a recognised agency to do some or all of the jobs you want to do, and they must be satisfied you are a fit and proper person to do those jobs.

The Director-General looks at things like whether you are competent to do the jobs, if you have any convictions, what your character and reputation are like, and if you can stay impartial. They also think about if you can meet the requirements of the Animal Products Act. The Director-General can look at other things they think are relevant too.

When the Director-General decides if you are a fit and proper person, they consider things like your ability to do the jobs, and if you have been convicted of anything, as stated in section 111(1).

103Recognition of persons

  1. The Director-General may, on the application of a natural person, recognise that person to carry out specified functions and activities.

  2. Before recognising an applicant, the Director-General must—

  3. consider whether to impose a condition under section 111(1) requiring the applicant to be managed, employed, or engaged by a recognised agency to carry out some or all of the permissible functions and activities for which recognition is sought; and
    1. be satisfied that the applicant is a fit and proper person to carry out the permissible functions and activities for which recognition is sought.
      1. In determining whether an applicant is a fit and proper person, the Director-General—

      2. must take into account the following matters:
        1. the competency of the applicant to carry out the permissible functions and activities for which recognition is sought; and
          1. any specified conviction entered against the applicant; and
            1. the applicant’s character and reputation; and
              1. the applicant’s ability to maintain an appropriate degree of impartiality and independence in carrying out the permissible functions and activities for which recognition is sought; and
                1. any applicable requirements of this Act; and
                2. may take into account any other matters that the Director-General considers relevant.
