112I: Recognised agency or person may act in other capacities

"People with special jobs can do other work, but must be clear about their role."

If you are a recognised agency or person, you can do other jobs outside of your main tasks. You just cannot do these extra jobs as a recognised agency or person. You must do them in a different role, and not pretend to be acting as a recognised agency or person, as stated in section 112G or 112H.

If you follow these rules, nothing in section 112G or 112H will stop you from doing other jobs. You can work in different areas, as long as you do not use your recognised agency or person title. This means you have to be clear about what role you are in when you are doing these extra jobs.

112IRecognised agency or person may act in other capacities

  1. Nothing in section 112G or 112H prevents a recognised agency or a recognised person from carrying out functions and activities that are outside the scope of the agency's or person's specified functions and activities, provided that the agency or person does not do so—

  2. in the agency's or person's capacity as a recognised agency or a recognised person; or
    1. while purporting to act as a recognised agency or a recognised person.
