112J: Suspension of recognition of recognised agency, recognised person, or recognised class

The Director-General can also stop or limit recognition if an agency or person has not paid a fee they were supposed to pay.

The Director-General can stop or limit recognition for up to 3 months. During this time, the Director-General can require the agency, person, or class to fix the problems that led to the suspension, or they can impose conditions that must be met before the suspension is lifted. You might be required to take corrective action to fix the issues that caused the suspension.

The Director-General has the power to decide what conditions must be met or what actions must be taken to lift the suspension, and they can require you to pay any outstanding fees or take other corrective action.

Suspension of recognition

112JSuspension of recognition of recognised agency, recognised person, or recognised class

  1. The Director-General may suspend all or part of the recognition of a recognised agency, recognised person, or recognised class if the Director-General has reasonable grounds to believe that—

  2. the performance of the agency, person, or a significant proportion of the members of the class is unsatisfactory, taking into account the requirements of the recognition; or
    1. the agency, person, or a significant proportion of the members of the class no longer meets 1 or more of the criteria on which that agency, person, or class was recognised under whichever of sections 101 to 105 applies; or
      1. the agency, person, or a significant proportion of the members of the class has failed to comply with section 112G or 112H or any other applicable requirements of this Act, and that failure causes the Director-General to question the ability of the agency, person, or class to carry out the specified functions or activities of the agency, person, or class; or
        1. for an agency or a person, the agency or person has failed to pay an ongoing recognition fee, charge, or levy within 30 days after the date on which it was due and payable.
          1. The maximum period of suspension is 3 months.

          2. The Director-General may do either or both of the following:

            1. require a suspended agency, person, or class to take appropriate corrective action to remedy the deficiency or failure that resulted in the suspension.
