165C: Effect of use of system

If you use an automated electronic system to do something, this section applies to you. You do things by the system, and it is treated as if you did them properly, as long as you follow the rules in the Act, like those mentioned in section 165B(3). The system's actions are not invalid just because the system did them.

When the system does something allowed or required by another law, and it follows the rules for using automated electronic systems in that law, the action is treated as if you did it properly, as stated in section 165B(3). The action is not invalid just because the system did it.

165CEffect of use of system

  1. This section applies to an action done by an automated electronic system.

  2. An action allowed or required by this Act done by the system—

  3. is treated as an action done properly by the appropriate person referred to in section 165B(3); and
    1. is not invalid by virtue only of the fact that it is done by the system.
      1. If an action allowed or required by another enactment done by the system is done in accordance with any applicable provisions in the enactment on the use of an automated electronic system, the action—

      2. is treated as an action done properly by the appropriate person referred to in section 165B(3); and
        1. is not invalid by virtue only of the fact that it is done by the system.
          1. If the system operates in such a way as to render the action done or partly done by the system clearly wrong, the action may be done by the appropriate person referred to in section 165B(3).
