132: Breach of compliance order

If you break a compliance order or an interim compliance order without a good reason, you commit an offence against the Animal Products Act 1999. These orders are issued under section 150 or section 151. You must follow the terms of the order.

If you commit this offence, you can be fined when you are convicted. The fine can be up to $300,000 if you are a company, or up to $50,000 if you are an individual.

You can also be fined an extra $2,000 for every day the breach continues.

132Breach of compliance order

  1. A person commits an offence against this Act who, without reasonable excuse, breaches or fails to comply with the terms of a compliance order or interim compliance order issued under section 150 or section 151.

  2. A person who commits an offence against this section is liable on conviction to—

  3. a fine not exceeding—
    1. $300,000, in the case of a body corporate; or
      1. $50,000, in the case of an individual; and
      2. an additional fine not exceeding $2,000 for every day on which the breach or failure continues.
