134: Offence of breach of duty

If you are in charge of a risk management programme, you must follow the duties in section 16. If you do not, you can commit an offence. You can also commit an offence if you are a recognised agency and do not follow the duties in section 112G, or if you are a recognised person and do not follow the duties in section 112H, or if you are a registered exporter and do not follow the duties in section 51.

If you commit an offence, you can get a fine. The fine can be up to $200,000 if you are a company, or up to $50,000 if you are an individual.

You will only get a fine if you do not have a reasonable excuse for not following the duties.

134Offence of breach of duty

  1. A person commits an offence who, without reasonable excuse,—

  2. being the operator of a risk management programme, breaches or fails to carry out any of the duties specified in section 16; or
    1. being a recognised agency, breaches or fails to carry out any of the duties specified in section 112G; or
      1. being a recognised person, breaches or fails to carry out any of the duties specified in section 112H; or
        1. being a registered exporter, breaches or fails to carry out any of the duties specified in section 51.
          1. A person who commits an offence under subsection (1) is liable on conviction to—

          2. in the case of a body corporate, a fine not exceeding $200,000:
            1. in the case of an individual, a fine not exceeding $50,000.
