119: Renewal of employer licence

You can renew your employer licence if it hasn’t been cancelled. To do this, you need to send an application to the Registrar. The application must be in the right form and include all the information and documents the Board asks for. You also need to pay a fee if there is one.

When the Registrar gets your application, they will send it to the Board. The Board will look at your application and decide if they can renew your licence. They can renew it for up to 5 years. But they will only renew it if you meet all the requirements for getting an employer licence.

If you send in your application before your licence runs out, but the Board hasn’t made a decision yet, your licence will stay valid until they do. If they renew it, the new licence will start from when the old one would have ended.

119Renewal of employer licence

  1. Every employer licence, unless it has been cancelled, may from time to time be renewed in accordance with this section.

  2. An application for the renewal of an employer licence must—

  3. be sent or delivered to the Registrar; and
    1. be in the prescribed form or, if there is no prescribed form, in the form required by the Board; and
      1. contain, or be accompanied by, the information and documentation required by the Board; and
        1. be accompanied by the prescribed fee (if any).
          1. The Registrar must refer any application received by the Registrar under subsection (2) to the Board for consideration under this section.

          2. On receiving an application under subsection (3), the Board may renew the employer licence to which the application relates for the period (not exceeding 5 years) that the Board thinks fit.

          3. However, the Board must not renew an employer licence unless the Board is satisfied that the applicant meets all the requirements for the issue of an employer licence.

          4. If an application for the renewal of an employer licence has been made but not dealt with before the licence expires, the licence continues in force until the application is dealt with by the Board, and any renewal in that case must take effect from the date on which the licence would (but for the renewal) have expired.
