147Y: Orders to be in writing

When the Board makes an order under section 147M, they need to write it down. The order must explain why it was made and tell you that you can appeal it. It also needs to say when you have to appeal by. The person in charge of the Board has to sign the order.

The Registrar will give you a copy of the order. The order starts working either when it says it does in section 147P, or from the day you get it (or later if the order says so).

The Registrar also has to give a copy of the order to the person who looked into the complaint and the person who made the complaint, if there was one.

If the Board says to, the Registrar will also give a copy of the order to the person who owns and the person who lives in the place the complaint was about.

147YOrders to be in writing

  1. Every order of the Board under section 147M must—

  2. be in writing; and
    1. contain a statement of the reasons on which it is based; and
      1. contain a clear statement of the right of the person in respect of whom it is made to appeal against the order, and the time within which notice of appeal must be given; and
        1. be signed by the Presiding Member of the Board.
          1. A copy of every order of the Board under section 147M must be served by the Registrar on the person in respect of whom it is made, and takes effect—

          2. in accordance with section 147P; or
            1. from the day on which service is effected, or any later date that is specified in the order.
              1. The Registrar must ensure that a copy of any order made under section 147M is given, as soon as practicable, to—

              2. the investigator who investigated the complaint; and
                1. the complainant (if any).
                  1. The Registrar must, if the Board so directs, give a copy of any order made under section 147M to the owner and to the occupier of the premises to which the complaint relates.
