114: Board may delegate power to Plumbers, Gasfitters, and Drainlayers Board to act under this subpart

114Board may delegate power to Plumbers, Gasfitters, and Drainlayers Board to act under this subpart

  1. The Board may delegate any of the functions or powers of the Board under this subpart, either generally or specifically, to the Plumbers, Gasfitters, and Drainlayers Board.

  2. The Plumbers, Gasfitters, and Drainlayers Board may, unless the delegation provides otherwise, perform the function or exercise the power in the same manner, subject to the same restrictions, and with the same effect as if the Plumbers, Gasfitters, and Drainlayers Board were the Board.

  3. If the Plumbers, Gasfitters, and Drainlayers Board purports to perform a function or exercise a power under a delegation, the Plumbers, Gasfitters, and Drainlayers Board—

  4. is, in the absence of proof to the contrary, presumed to do so in accordance with the terms of that delegation; and
    1. must produce evidence of its authority to do so, if reasonably requested to do so.
      1. The Plumbers, Gasfitters, and Drainlayers Board must—

      2. give effect to any direction given to it by the Board in relation to the performance of functions or the exercise of powers under this section; and
        1. notify the Board if it has registered a person or issued a licence under this Act.
          1. No delegation under this section—

          2. affects or prevents the performance of any function or the exercise of any power by the Board; or
            1. affects the responsibility of the Board for the actions of the Plumbers, Gasfitters, and Drainlayers Board acting under the delegation; or
              1. is affected by any change in the membership of the Plumbers, Gasfitters, and Drainlayers Board or the Board.
