147ZA: Appeals

You could also call this:

“You can ask a court to review decisions about your electrical work qualifications”

If you are unhappy with a decision, direction, or order made about you, you can appeal to the District Court. This applies to several situations:

You can appeal if the Board decides not to register you, not to give you a licence, or not to renew your licence.

You can appeal if the Board decides not to give you a limited certificate under section 78 or not to renew your limited certificate.

You can appeal if the Board suspends or cancels your registration or licence.

You can appeal if the Board puts any terms or conditions on your registration or licence, or changes these terms or conditions.

You can appeal against any decision, direction, or order made under sections 108, 109, 120, 133, 137, and 153 or Part 11 (except section 147C).

If the Plumbers, Gasfitters, and Drainlayers Board makes a decision under this Act, it’s treated the same as a decision by the Board for appeals.

You can’t appeal against decisions made under sections 84 to 90.

Part 12 Appeals

147ZAAppeals

  1. A person who is dissatisfied with the whole or any part of any of the following decisions, directions, or orders may appeal to the District Court against the decision, direction, or order:

  2. any decision of the Board to decline to register the person or to decline to issue a licence to the person or to decline to renew the licence of the person:
    1. any decision of the Board to decline to issue a limited certificate under section 78 to the person or to decline to renew the limited certificate of the person:
      1. any decision of the Board to suspend or cancel the person's registration or licence:
        1. any decision of the Board to impose any term or condition in relation to the person's registration or licence or to vary any of those terms or conditions:
          1. any decision, direction, or order under any of sections 108, 109, 120, 133, 137, and 153 or Part 11 (except section 147C).
            1. For the purposes of this Part, any decision of the Plumbers, Gasfitters, and Drainlayers Board acting under this Act must be treated as a decision of the Board.

            2. Subsection (1) does not confer a right to appeal against a decision under any of sections 84 to 90.
