111: Effect of suspension

When your registration is suspended, you are not considered a registered person for that type of registration during the suspension period. If you have a practising licence for that registration, it is also suspended at the same time.

If your practising licence is suspended, you are not considered to have a current practising licence for that type of registration during the suspension. You are not allowed to do work or help with work under that licence while it is suspended.

If you have a provisional licence and it gets suspended, you are not considered a provisional licence holder during the suspension. You are not allowed to do work or help with work under that licence while it is suspended.

When the suspension period ends, your registration, practising licence, or provisional licence becomes active again right away, unless there is another reason to keep it suspended or cancel it.

Even when your registration or practising licence is suspended, the Registrar can still include information about you in the register. The same applies for provisional licence holders.

111Effect of suspension

  1. If a person's registration is suspended,—

  2. the person is not a registered person, for the class of registration concerned, for the period during which the registration is suspended; and
    1. the practising licence held by the person for the class of registration concerned (if any) is also suspended for the period during which the registration is suspended.
      1. If a person's practising licence is suspended, the person—

      2. is not the holder of a current practising licence, for the class of registration concerned, for the period during which the licence is suspended; and
        1. is not authorised to do, or assist in doing, work under that licence for the period during which the licence is suspended.
          1. If a person's provisional licence is suspended, the person—

          2. is not a provisional licence holder for the period during which the licence is suspended; and
            1. is not authorised to do, or assist in doing, work under that licence for the period during which the licence is suspended.
              1. At the end of the period of suspension, the person's registration, practising licence, or provisional licence is immediately revived (unless there is some other ground to suspend or cancel the registration or licence).

              2. Subsections (1) and (2) do not prevent the Registrar from including information in the register in relation to the person under section 128(1).

              3. Subsection (3) does not prevent the Registrar from including information in the register in relation to the person under section 128(2).
