When someone is accused of committing an infringement offence, there are two ways to handle it. You can either be taken to court through a formal process, or you can be given an infringement notice.

If you’re taken to court, a document will be filed to start the legal process. This is done under a specific part of the Criminal Procedure Act 2011.

If you’re given an infringement notice, it will be done according to another part of the law called section 165B.

Some people, like WorkSafe, the Registrar, or the Board, can start legal proceedings for an infringement offence without needing special permission from a judge or court official. They can do this by filing a document under the Criminal Procedure Act 2011.

165AInfringement offences

  1. If a person is alleged to have committed an infringement offence, the person may either—

  2. be proceeded against by filing a charging document under section 14 of the Criminal Procedure Act 2011; or
    1. be served with an infringement notice as provided in section 165B.
      1. Despite section 21 of the Summary Proceedings Act 1957, leave of a District Court Judge or Registrar to file a charging document is not necessary if WorkSafe, the Registrar, or the Board commences proceedings for an infringement offence by filing a charging document under the Criminal Procedure Act 2011.
