113: Cancellation or suspension of overseas qualification, certificate, registration, or licence

113Cancellation or suspension of overseas qualification, certificate, registration, or licence

  1. The Board may review the registration, practising licence, or provisional licence of a person who was registered or issued with the licence by virtue of an overseas qualification, certificate, registration, or licence if satisfied that—

  2. the educational establishment that gave him or her an overseas qualification or certificate has cancelled or suspended it (or taken action equivalent to cancelling or suspending it); or
    1. an overseas authority that maintains a register of people registered or licensed as electrical workers has, as a result of disciplinary action taken against the person,—
      1. removed his or her name from that register; or
        1. cancelled his or her licence; or
          1. suspended his or her registration or licence; or
            1. taken action equivalent to an action referred to in subparagraph (i) or (ii) or (iii).
            2. The form of a review under this section is at the Board's discretion.

            3. However, in conducting the review, the Board must give the person concerned—

            4. the particulars that are reasonably necessary to clearly inform the person of the substance of the grounds on which the Board has decided to carry out the review; and
              1. a reasonable opportunity to make written submissions and be heard on the question, either personally or by his or her representative.
                1. After the review, the Board may, if it thinks fit,—

                2. order the suspension of the person's registration, practising licence, or provisional licence for any period it thinks fit; or
                  1. order the cancellation of the person's registration, practising licence, or provisional licence.
                    1. The Registrar must ensure that a copy of the order made under subsection (4) is given to the person concerned.

                    2. An order made under subsection (4) takes effect from the day on which a copy of the order is given to the person concerned or from any date that is specified in the order, whichever is the later.
