If the Board thinks it’s necessary to protect the safety of the public, they can make an order to suspend or disqualify someone. This can happen before or after they’ve told the person about a complaint against them.

The order can do two things:

  1. It can stop someone from using their practising licence or provisional licence for a while.
  2. It can stop someone from doing or helping with certain electrical work that they would usually be allowed to do.

This order stays in place until one of these things happens:

  1. The person looking into the complaint decides the Board doesn’t need to look at it.
  2. The Board decides they don’t need to punish the person.
  3. The Board does something else to deal with the situation.

The Board can make this order if the person investigating suggests it, or if they decide to do it on their own. They don’t have to tell the person first that they’re going to make this order.

147IInterim suspension or disqualification

  1. The Board may make an order under subsection (2)—

  2. before or after a notice has been served on a person under section 147H; and
    1. if it is satisfied that it is necessary to do so having regard to the need to protect the safety of members of the public.
      1. An order under this subsection is either—

      2. an order suspending the person's practising licence or provisional licence; or
        1. an order disqualifying a person from doing, or assisting in doing, prescribed electrical work that the person would otherwise be authorised to do or assist in doing.
          1. An order under subsection (2) continues in force until—

          2. the investigator determines that the complaint should not be considered by the Board; or
            1. the Board determines that it should not exercise its disciplinary powers under section 147M; or
              1. the Board does any of the things authorised by section 147M.
                1. The Board may make an order under subsection (2) on the recommendation of the investigator or on its own motion.

                2. Despite section 156, the Board is not required to give any notice to a person that it intends to make an order under subsection (2) in respect of that person.
