211Amendments to Commodity Levies Act 1990

  1. This section amends the Commodity Levies Act 1990.

  2. Section 19(1) is amended by—

  3. omitting A District Court Judge, a Justice, a Community Magistrate, or a Court Registrar (not being a constable) who, on an application in writing made on oath and substituting An issuing officer (within the meaning of section 3 of the Search and Surveillance Act 2012) who, on an application made in the manner provided in subpart 3 of Part 4 of that Act; and
    1. omitting in the form set out in the Schedule to this Act.
      1. Section 19 is amended by repealing subsection (2) and substituting the following subsections:

      2. Subject to subsection (2A), the provisions of Part 4 of the Search and Surveillance Act 2012 apply.

      3. Despite subsection (2), sections 118 and 119 of the Search and Surveillance Act 2012 apply only in respect of a warrant issued to a named constable or to every constable.

      4. Sections 20 to 22 and the Schedule are repealed.
