Enforcement officers' powers and orders - Production orders

74: Issuing officer may make production order

You could also call this:

"A police officer or judge can order you to give them something if they think you have it and it's needed for an investigation."

An issuing officer can make a production order against you if they are satisfied that certain conditions are met. They must receive an application under section 71 to consider making the order. The conditions for making the order are specified in section 72.

The issuing officer will look at the application and the conditions to decide if they should make the production order against you. They can only make the order if they are satisfied that the conditions are met. This means they have to be sure that everything required by the conditions is in place.

You might receive a production order if the issuing officer is satisfied with the application and the conditions. The order will be made based on the information in the application and the conditions in section 72. The issuing officer's decision will depend on what is in the application and whether the conditions are met.
